Lawyer Appointment Questions - Updated October 2007
1. Who provides legal representation to youth who are secured under the Enhancement Act or PSEC Act?
Lawyers under special contracts provide these services in Calgary and Edmonton so youth can be guaranteed timely access to lawyers. In all other areas of the province, lawyers are appointed from the regular roster.
2. Can an appointed lawyer have an agent appear for him or her in court?
Yes, but the appointed lawer is expected to attend the initial hearing and all other "hearings of substance".
3. What details are required in a status or final report to LRCY regarding a case?
We expect enough detail to understand the status of the case and to determine if the lawyer is complying to the service standards.
4. Some of the fees and tariffs you have set seem low. Will you be revising your fees and tariffs?
Fees and tariffs are reviewed on an on-going basis.
5. How will legal appointments be handled when the children are already represented by counsel in a private custody matter?
If the children also require counsel for an Enhancement Act matter, we will explore having the same lawyer represent the children in both matters.
6. Often it takes longer than the allotted 30 hours to prepare a case and interview the children and witnesses. Can the number of non-court hours be extended for my case?
Yes. The lawyer must send the LRCY manager a brief outline of the need and an estimate of the number of additional hours required. There is no limit to the amount of court time that can be claimed.
7. When does a lawyer's appointment end?
45 days after the court or appeal panel has made a decision.
